Privacy Policy

Effective from January 1, 2023

This Privacy Policy governs the relationship between the Service Provider (hereinafter referred to as QB Tools) and any individual, sole proprietorship, or legal entity (hereinafter referred to as the Client) regarding the processing of personal data and information when using the QB Tools service. The Privacy Policy applies to all data and information obtained by QB Tools from the Client/Administrator/User during the use of the service.

If any of the conditions specified in this Privacy Policy are not accepted by the person intending to use the Service, such person is not entitled to use the Service.

1. General provisions

1.1. This Privacy Policy is developed in accordance with the current legislation of Ukraine and the requirements of GDPR.

1.2. Reviewing and agreeing to this Privacy Policy is mandatory for using the QB Tools service.

1.3. Key Terms: Personal Data - information or a set of information about an individual that is identified or can be clearly identified; GDPR - the regulation of the European Union on the protection of personal data of all individuals within the European Union and the European Economic Area; Consent of the data subject - a voluntary expression of consent to the processing of personal data for a specific purpose of their processing; Processing of personal data - any action or set of actions, such as collection, recording, accumulation, storage, adaptation, alteration, updating, use, distribution (including transmission), depersonalization, destruction of personal data, including using information (automated) systems.

1.4. By registering and using the QB Tools service, the Client confirms that they have read all applicable documents (Terms of Access and Use) and this Privacy Policy.

1.5. When registering a user - Client in QB Tools, a corresponding account (profile) containing a number of personal data is created. The Client guarantees and is responsible for the accuracy, completeness, and relevance of such data.

1.6. In case QB Tools has grounds to believe that the provided information is incomplete, inaccurate, or does not correspond to reality, QB Tools has the right to request supporting documents from the Client, as well as at its discretion, temporarily block or completely delete the account, and also prohibit the Client from fully or partially using the QB Tools service.

1.7. During sign-up and while using the Service, the Client gives their phone number.

1.8. The Client is solely responsible for sharing their access data (such as name and phone number) for the service, for entering personal data into the QB Tools Service, and for the content they provide, including ensuring it complies with current legislation.

2. The informatiuon we gather and might handle

2.1. To ensure quality service delivery to its clients, QB Tools needs to obtain certain information about the client, including general personal data of users. However, QB Tools limits itself to a minimum list of information and data necessary for service provision and goal achievement.

2.2. The information provided by the client to QB Tools may include:

  • personal data, including third-party data (Administrator, User): name, date of birth, gender, postal address, email address, phone number, information about bank accounts (card accounts), industry practice (activity), photograph, Internet Protocol (IP) address, browser type, Internet Service Provider (ISP), referral pages, interests, login/logout dates and times, operating system;

  • the information that constitutes the scope of the Client's employment relationship;

  • the information we obtain about the Client from other official sources, including social networks, and through messengers configured to work with the service.

2.3. The Client confirms and guarantees that they have obtained all necessary permissions and consents for the placement of personal information about third parties, and also guarantees the full and unconditional consent of the aforementioned individuals to all provisions of this Privacy Policy.

2.4. QB Tools doesn't control the accuracy and relevance of the information provided by the Client, however, it reserves the right to demand confirmation of its accuracy at any time.

2.5. QB Tools may offer the possibility of integrating the service with products from third-party providers. QB Tools also reserves the right to place links to third-party websites/services. In doing so, QB Tools does not take responsibility for the collection, storage, and processing of personal information by third-party software developers, which the Client or user provides to such third-party providers. Individuals should independently review the policies of such third-party websites/services.

2.6. QB Tools also uses Cookies to collect analytical data for personalizing content, marketing, analytics, performance measurement, ensuring security features, and their activation. Such data collection is carried out in accordance with the Cookie Policy.

2.7. The use of the QB Tools service by the Client implies the full and unconditional consent of the Client and their users to the storage and processing of personal data and information provided to QB Tools.

3. Data Handling Principles

3.1. The collection and processing of personal data and information are carried out in accordance with the principles established by law, including but not limited to:

  • the collection and processing are done lawfully and transparently;

  • specificity and clarity of purpose; data minimization (collection and processing only of necessary data);

  • accuracy of data;

  • definiteness of the data retention period;

  • integrity and confidentiality.

3.2. Any actions regarding personal data by QB Tools are carried out and/or may be carried out exclusively on lawful grounds and in accordance with the principles established by law.

4. The purpose/purposes of processing personal data

4.1. The collection and processing of personal data may be conducted for the following purpose/purposes:

  • for the proper provision of access and use of the QB Tools service to the Client;

  • for improving the operation of the service, including upgrading it according to the Client's needs;

  • for marketing purposes, namely, informing the Client about new products of the service;

  • for facilitating communication with the technical support department, marketing department, and other structures of QB Tools, including for accepting proposals from the Client;

  • for ensuring the implementation of the rights of the Client and users of the service;

  • for resolving conflict situations.

  • ensuring the operation of certain functions of the service, for example, the operation of the referral program (function - friend requests) for which the system stores the phone book data of the application user.

4.2. QB Tools reserves the right to publish/post personal reviews of the Service provided by the Client on its website. If the Client wishes to remove their review, they must send a corresponding email to info@qbtools.com info@qbtools.com

5. Security of personal information, confidentiality, and storage conditions

5.1. QB Tools implements necessary legal, organizational, and technical measures to protect information and ensure the security of Personal Data. Connection to the system is only possible using Transport Layer Security (TLS) technology. The system adheres to widely accepted security standards and includes administrative and technical measures and procedures to protect Personal Data, among such measures (but not exclusively):

  • Defense in Depth

  • Web application firewall

  • Input validation

  • 24/7 security monitoring and management

  • Frequent vulnerability scanning

  • Encryption conforming to industry standards

  • Penetration testing

QB Tools and its representatives never request Client account credentials. We recommend: ensuring that access to the system is only from trusted environments and devices with a reliable level of protection, including network and antivirus protection.

5.2. QB Tools informs that the data provided by the Client and/or their users, as well as the Client's Content, will be hosted, backed up, and stored on secure certified servers located in Western Europe and/or North America. Such backup and copying ensure the security of data storage and facilitate the recovery of lost or damaged content in case of emergencies.

5.3. QB Tools adheres to international requirements and ensures compliance with legal, organizational, and technical requirements in the activities of contractors who may be engaged to ensure the effective operation of the Service.

6. Cases of disclosure of personal information

6.1. QB Tools adheres to all requirements for maintaining the confidentiality of personal data and protection against disclosure of personal data and information.

6.2. QB Tools may disclose personal data to third parties with the written consent or instruction of the Client in accordance with the instructions provided by the Client. Personal data may be transferred for the performance of a contract, the other party to which or beneficiary or guarantor of which may be the Client, provided that prior consent or appropriate instructions are obtained from the Client.

6.3. Personal information may be transferred for the purpose of connecting and/or registering third-party software products on behalf of the Client, provided that prior consent or appropriate instructions are obtained from the Client.

6.4. Personal data may be used to protect the rights and legitimate interests of the service or third parties in cases where the User violates the copyright and other intellectual property rights of QB Tools and/or the relevant Agreement by transferring data to regulatory/law enforcement authorities or the court, as well as at the request of judicial authorities based on the relevant ruling or decision.

7. Rights of the data subject

7.1. The data subject has the right to:

  • to the protection of their personal data within the framework of this privacy policy, the applicable legislation of Ukraine, and GDPR norms;

  • access their personal data; clarify the provided personal data and update it (making changes, updating data, etc.);

  • request the cessation of processing their personal data (which may result in automatic cessation of service provision);

  • request the deletion of personal data;

  • demand that QB Tools refrain from using personal data for marketing purposes by sending a corresponding letter to info@qbtools.com

  • contact QB Tools for clarifications regarding the processing of personal data by sending a corresponding letter to info@qbtools.com

7.2. The Service Client has the right to:

  • edit their account (profile) independently by making changes and additions according to the available functionality;

  • in case of discontinuation of using the service, demand the deletion of all account data and content (except for data that must be retained in accordance with legislative requirements);

  • upload content related to the Client's activities and export content at any convenient time;

  • leave reviews about the work of QB Tools.

8. Legal protection mechanisms

8.1. The data subject has the right to exercise available rights to protect their personal data in accordance with legislatively defined procedures.

8.2. To ensure and protect their rights regarding personal data when using QB Tools services, the data subject can address any questions to QB Tools by sending a corresponding request to the email address info@qbtools.com

8.3. The data subject has the right to contact the relevant competent authorities in case of violation of their rights regarding personal data.

9. Final provisions

9.1. QB Tools reserves the right to unilaterally amend this Privacy Policy by posting the policy terms in a new edition on the qbtools.com website

9.2. QB Tools recommends periodically checking the Privacy Policy for any changes.

9.3. The use of the QB Tools service is governed by the Agreement or Terms of Access and Use.

9.4. In the event of any discrepancies between this Privacy Policy and the provisions of the Agreement or Terms of Access and Use, the relationship shall be governed by the provisions of the Agreement or Terms of Access and Use.
